DUI Deadly Car Accident in Ohio Results In Five Wrongful Deaths

OHIO, October 31, 2007 - A pickup truck slammed into a minivan killing five individuals. This is one of the worst DUI car accidents to result in wrongful death in a long time. The trucker was DUI and his acts of driving under the influence caused him to collide head on with the minivan. This killed a woman, her four children and caused serious injuries to at least 3 more individuals. The truck versus passenger car head on collisions occurred around 4 miles or so from where the DUI driver drove into the highway traveling from the wrong direction.

The defendant who was driving while under the influence according to police, is named Michael Gagnon. He is just 24 years old. He was apparently so inebriated that he took his truck north on the southbound Interstate 280 late Sunday driving head on into highway traffic. The truck collided head on into the minivan. The accident scene was strewn with children’s toys, wrapping paper for presents, stuffed toy animals according the police.

Defendant Gagnon, tested positive to a blood-alcohol content (BAC) of .254 following his apprehension and arrest. This is more than three (3) times the legal blood alcohol content allowed in California and many other states. Those states have a legal BAC of .08. Defendant Gagnon was charged with aggravated vehicular homicide.

At least one witness confirms that Defendant Gagnon had been drinking that night and that he took off in his truck. Gagnon was apparently so drunk before the truck accident, employees at a fast food joint called the police on him, but the defendant fled the scene before the cops arrived. Other vehicle driver’s called the police as well, but the deadly car crash took place before the police could do anything.

Many of the victims in the passenger van were ejected and thrown out according to the police. The victims are 36 year old Bethany Griffin, 10 year old Jordan Griffin, 2 month old Vadi Griffin, 7 year old Lacie Burkman, 10 year old Haley Burkman, 10. All of these victims suffered wrongful death.

Lindsay Lohan Claims She Was Sober in Drunk Driver Car Crash Case

LOS ANGELES (AP) — Today, 12-26-07, Lindsay Lohan claimed was not drunk driving in her 2005 car crash accident in the Beverly Hills area.

Lohan, now 21 year old is in the middle of a tort lawsuit by Los Angeles personal injury lawyers in a motor vehicle negligence lawsuit that occurred when she was operating a Mercedes-Benz automobile that collided with a passenger van, causing injuries to the plaintiff vehicle operator by the name of Raymundo Ortega.

Plaintiff Ortega, claimed in his tort claims facts that Lohan was drinking alcohol while a customer of The Ivy Restaurant. That, Lohan was not 21 when she was served drinks at the Ivy Restaurant, and therefore Lohan and the Restaurant must pay Plaintiff Ortega $200,000 or more in the Los Angeles car crash involving injuries.

Readers will recall that on December 15, Lohan stated under penalty of perjury in a legal declaration that: "I did not consume an alcoholic beverage or any type of medication or drug" that was taken while at the restaurant, or somewhere else.

Lohan has is involved in a cross complaint against Ortega, claiming Ortega caused the accident because the California Highway Patrol Highway Collision Report indicates Ortega to be the cause of the accident for making an illegal U-turn, causing Lohan’s car to crash into Ortega’s.

Lohan plead guilty to misdemeanor drunken driving charges and possession of cocaine in another incident and was only forced to stay in jail for 84 minutes on those charges. At Least 1 Death in 80 Car Crash Pileup

AMARILLO — At least one death in an 80 car crash pile up was reported today as well as information that two dozen or more others were injured in a huge pileup shutting down Interstate 40 in Amarillo Texas yesterday.

More than 50 motor vehicles, that includes,big rig trucks and passenger cars crashed into eachother or stationary objects, due to a chain-collision thought to be caused from bad visibility from a snow drift according to Amarillo police officers.

"There were cars crashing while they [firefighters] were there," according to Amarillo Fire Department Captain Bob Johnson from a public source. "They could hear them [the crashes], but they couldn't see them ... You've got no visibility and cars crashing into each other."

Authorities confirmed one death so far. Authorities are uncertain how long it will take to determine the actual cause of the incident, or the total number of vehicles. It is reported that several cars may have vacated the accident site to make reports at the station.

Authorities related that at least 18 individuals transported to Texas hospitals. At least two people had serious injuries. At least one of the accidents was due to a passenger vehicle being pinned under a tractor trailer-big rig truck. Damaged cars were strewn across the snow covered road from the car accident. Motor Vehicle Crash Shuts Down Bridge

SPRING LAKE - December 18, 2007 By Hugh G. Ardon — At least four adults and children were injured in a two-car crash collision today at the or near the intersection of State Road and 148th Avenue.

Sgt. Steve Austin (not to be confused with the bionic man), a deputy attached to the Ottawa County Sheriff's Department, stated that Jessie VanDonklaar, who is 21 years of age and live in Spring Lake Township, was driving in her passenger vehicle, headed South on 148th Avenue at approximately 8:05 a.m. VanDonklaar then turned into the path of a Ford Taurus headed north by her driveway located at 17668 148th Ave.

The Ford Taurus was being operated by Jennie Kubicek, who is 24 years old and who resides in Spring Lake as well. The car veered off Focus Road and went out of control when it crashed into a wooden bike path bridge. VanDonklaar's motor vehicle then veered to the right and went down off the shoulder of the road and came to a sudden stop. Initial report indicate two infants or young kids were in the back seat of both vehicles.

VanDonklaar got trapped inside of her automobile an was freed by Spring Lake Township firefighters. Her two children named Lexis and Chloe suffered cuts and lacerations. All three victims were evacuated via ambulance to a local hospital. There is no information on their conditions as of yet.

Kubicek and her two kids who are 1 year and 4 years old were also evacuated to the hospital. There was also another passenger riding in her car not injured according to police. Part of 148th Avenue between State Road and Kelly Street was closed for about an hour as a result of the motor vehicle crash authorities said.
